Mediation presents a critical opportunity in the life of litigation. 

The degree to which you and your client are prepared can impact your chances of reaching a settlement that maximizes your client’s interests. This CPD will touch on risk analysis, pre-mediation conferences, content of mediation briefs, practical considerations for multi-party cases, and the underlying interests of the parties as important things to consider before your mediation.

Advocacy at mediation can also impact the outcome – but advocacy at mediation is different than advocacy at trial. This CPD will address mediation advocacy, mediator strategies and styles and how you can create value for your client at mediation even where no settlement is reached. 

Speaker

Jennifer Egsgard, Egsgard Mediation

Called to the bar in 2002, Jennifer Egsgard has been mediating contract, commercial, insurance, employment, personal injury, product liability and other disputes since 2018. Advocates who have used Jennifer as a mediator have said that she has: “tremendous skills with dealing with complicated parties and situations”, “high level of skill and natural aptitude”, and is able to “gain the trust of both sides”.

She completed the Mediating Commercial Disputes program at Harvard Law School, and the Mediator Skills Training course at the Centre for Effective Dispute Resolution (CEDR)  in London, UK. Jennifer’s legal career included 6 years practicing commercial litigation in Toronto at Fasken, and 7 years as a partner with Sills Egsgard LLP. She is currently a Member-at-Large Practice Group leader for the Advocates’ Society Arbitration & Mediation Advocacy Practice Group. Jennifer is a frequent speaker at professional organizations, such as the Ontario Bar, American Bar and Canadian Corporate Counsel Associations, International Academy of Mediators,  UK Department of Justice, in-house legal teams of large organizations,  Prospectors and Developers Association of Canada and various law schools, often on topics related to mediation and dispute resolution.

Jennifer appreciates working with people of different backgrounds, having grown up in a small Ontario town, and later living in London, NYC, Washington DC, New Hampshire, New Mexico, Switzerland, Toronto and India.
